Introduction

These terms of use (“Terms”) govern your use of the TopScoredFantasy website and mobile application (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

The Service is operated by TopScoredFantasy (“we”, “us”, or “our”). We offer a fantasy sports platform focused on tennis tournaments.

Definitions

For the purposes of these Terms:

• “Account” means the unique account created for you to access our Service.
• “Application” means the software provided by us, downloaded by you to any electronic device called TopScoredFantasy.
• “Website” refers to TopScoredFantasy, accessible from www.topscoredfantasy.com
• “Service” refers to the Application or the Website, or both.
• “Terms” means these Terms of Use, which form the entire agreement between you and TopScoredFantasy regarding the use of the Service.
• “You” means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third party service.

You agree not to disclose your password to any third party. You must notify us immediately if you become aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity, or a name that is not lawfully available for use, a name or trademark that is subject to rights of a person or entity other than you without appropriate authorization, or a name that is offensive, vulgar, or obscene.

Age Restriction

The Service is intended for users who are at least 18 years old. By using the Service, you represent and warrant that you are of legal age to form a binding contract with us and meet the eligibility requirements set forth above. If you are under 18 years of age, you are prohibited from using the Service.

The Service and its original content (excluding content provided by users), features and functionality are and will remain the exclusive property of TopScoredFantasy and its licensors. User Content

Our Service allows you to post, display, and link, store, share and otherwise make available certain information, text, graphics, videos or other materials (“User Content”). You are responsible for the User Content that you post on or through the Service, including its legality, reliability and appropriateness.

By posting User Content on or through the Service, you represent and warrant that: (i) the User Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity.

You retain all of your rights to any User Content that you submit, post or display on or through the Service, and you are responsible for protecting those rights. We are not responsible and assume no liability for User Content that you or any third party posts on or through the Service.

Prohibited Use

You may use the Service only for lawful purposes and in accordance with the Terms. You agree not to use the Service:

• In any way that violates any applicable domestic or international law or regulation.
• For the purpose of exploiting, harming or attempting to exploit or harm minors in any way by exposing them to inappropriate content, soliciting personally identifiable information or otherwise.

• To impersonate the Company, a Company employee, another user, or any other person or entity, or attempt to do so.
• In any way that violates the rights of others, or in any way that is unlawful, threatening, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
• To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Service, or which, as determined by us, may harm or offend the Company or users of the Service, or expose them to liability.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account in the Application.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall TopScoredFantasy, its affiliates, agents, directors, employees, suppliers or licensors be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses that arise out of the use of or inability to use the Service.

Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change change will be determined in our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you may no longer use the Service.
